In recent years there has been a general attempt – inspired by P. F. Strawson – to naturalise Kant's notion of the transcendental self. The argument being that self-consciousness should refer to neither a kind of noumenal nor mental self but that the self-conscious subject must conceive of itself as an embodied entity, a person among persons that regards itself as an element of the objective order of the world. While Kant does not make room for the notion of an (...) embodied transcendental self, this is where we need to go as our bodily awareness is central both for self-knowledge and the possibility of cognition and thus a transcendental condition for knowledge claims. In this paper I should like to single out Quassim Cassam's work Self and World to see whether such a position is tenable. Cassam's main claim is that we can only become aware of ourselves as subjects if we are at the very same time aware of ourselves as objects located in the spatio-temporal world. We could not be self-conscious and ascribe experiences to ourselves unless we are also aware of ourselves as a physical object among other physical objects in the world. The central claim is that when we self-refer we do not refer to two distinct entities, one possessing only mental, and the other possessing only physical features, rather we refer to a subject that is both mental and physical at the very same time. Awareness of ourselves qua subject is just awareness of ourselves qua object. This paper will focus on this claim alone and will ask whether it is tenable. The answer will be negative. Drawing on the work of Edmund Husserl, I shall argue that there is an inherent flaw in Cassam's position which he has inherited from Gareth Evans’ depiction of the self. The contention will be that our awareness of ourselves qua subject is not compatible with the awareness of ourselves qua object. (shrink)

When Husserl speaks of the so-called ‘transcendental reduction’ or ‘phenomenological epochē’ many believe that he is eschewing the question of truth or existence. Two reasons are given for this: First, Husserl explicitly states that when we perform the reduction, we should no longer naively ‘accept [the world] as it presents itself to me as factually existing’ (Id I §30, p. 53) and should suspend our judgement with regard to ‘the positing of its actual being’ (Id I §88, p. 182). Second, (...) Husserl seems to have no problem in referring to an ‘object’ of thought even when we refer to non-existent, hallucinatory or indeed impossible objects. This seems to suggest that he is not interested in the question whether or not there is a corresponding ‘ordinary’ object. The paper seeks to question this and will show that his inquiry never loses sight of the questions of truth and existence but rather brings them into the foreground. (shrink)

P F Strawson advocates a descriptive metaphysics. Contrary to Kant, he believes that metaphysics should be ‘content to describe the actual structure of thought about the world’, there is no need of postulating a world that lies beyond our grasp. We neither need to refute nor accept scepticism since we can ignore it with good reasons. Yet this paper argues that Strawson fails to provide us with good reasons. He fails to realise that one cannot do metaphysics by construing its (...) claims as being merely descriptive of a conceptual scheme we find ourselves to possess without even purporting to establish the legitimacy of that scheme. The paper shows that it is possible to overcome this impasse if we endorse Kant's transcendental idealist position. I argue for the distinction between presuming that p and maintaining that presumably p. In order to make sense of this distinction, I defend a non-inferentialist conception of presumptions and offer an account of the correctness conditions for both presumptions and presumptive inferences. I characterize presumptions as a type of constative speech-act having certain semantic correctness conditions. In turn, regarding presumptive inferences, my strategy is to provide the correctness conditions for the use of an epistemic modal such as “presumably.” This (...) epistemic modal is characterized as a force indicator for speech-acts of concluding in complex speech-acts of arguing involving presumptive inferences. This text explores the potential of a political philosophy of vulnerability, feminist and egalitarian, focused on analyzing, publicizing and criticise the processes of mass production of precarity. The intersection of the main axes of power is identified as a producer of intersectional inequalities, following the intersectional approach of P. H. Collins and N. Yuval-Davis. The situations of vulnerability/precarity induced are connected to the normative dimension through the concept of intersectional injustice following the contribution of I. M. Young. Demographic differences among consumer groups have become increasingly important to the development of marketing strategies. Marketers depend heavily on the sales force to implement strategies at the consumer level and, not surprisingly, different groups may view the salesperson’s role differently. Unfortunately, unethical sales practices targeted at various consumer groups, and especially at seniors, have been utilized as well. The purpose of this study is to provide initial empirical evidence of the ethical ideological make-up of four age segments outlined (...) by Strauss and Howe (1991, Generations: The History of America’s Future 1584–2069, Morrow, New York) and to examine the propensity for these groups (seniors, in particular) to respond differentially to potentially unethical sales tactics. Data were collected from 179 respondents representing the four generational age groups. MANOVA revealed that the seniors in this study were distinct with respect to ethical ideology and less accepting of unethical sales tactics. Managerial implications are discussed for sales organizations to maximize their effectiveness across consumer groups. (shrink)

Leaders play a critical role in setting the tone for ethical climate in organizations. In recent years, there has been an increased skepticism about the role played by corporate executives in developing and implementing ethics in business practices. Sales and marketing practices of businesses, particularly in the pharmaceutical industry, have come under increased scrutiny. This study identifies a type of leadership style that can help firms develop an ethical climate. Responses from 333 salespeople working for a North American subsidiary (...) of an international pharmaceutical company were used to analyze the impact of instrumental leadership on ethical climate. We also examined the effect of ethical climate on effort, satisfaction with the supervisor, and job satisfaction. Managerial implications are provided. (shrink)

Famous philosophers and their conceits became the target of Lucian's satirical verve in many of his works. However, in Philosophies for Sale, Lucian offers an original view of philosophy. Just like a marketing expert would, Lucian treats philosophy as a product that is designed to satisfy the customers' needs, and whose nature is decisively influenced by consumer forces. My discussion is inspired by the main analytic tools and the basic core concepts of marketing. I argue that in Philosophies for Sale (...) Lucian revolutionized the established concept that philosophy as well as human sciences in general are not governed by market rules. On the contrary, he has shown that philosophy, just like any other activity involving a trade of values between two parties, can be assessed from an economic perspective and that, consequently, must be viewed as customer-creating value satisfactions, being subject to the law of supply and demand. Research and development (R&D) as well as marketing contribute to the credibility of the food company Unilever and its claims. Innovation encompasses the development, marketing, and sales of products. These are directed towards three distinct audiences: scientific peers, regulators, and consumers. R&D uses scientific articles to create credit for itself amongst peers and regulators. These articles are used to support health (...) claims on products. However, R&D, regulation, and marketing are not separate realms. A single strategy of credibility engineering connects health claims to a specific public through linking that public to a health issue and a food product. (shrink)

Abstract. In this article we developed scientific and applied foundations of commercialization of the nature-resource potential of anthropogenic objects, on the example of exhausted mines. It is determined that the category of “anthropogenic object” can be considered in a narrow-applied sense, as specific anthropogenic objects to ensure the target needs, and in a broad theoretical sense, meaning everything that is created and changed by human influence, that is the objects of both artificial and natural origin. It was determined that problems (...) of commercialization of the natural-resource potential of anthropogenic objects are most often considered by researchers for specific objects, without having complex methodological coverage from the point of view of combining environmental, technical, economic and managerial components. When studying the substantiation of the scientific base, the authors confirmed the feasibility of the commercialization of natural-resource potential of anthropogenic objects on the example of a number of theoretical scientific studies in reclamation, reconstruction, recreation, remediation, restoration of biological productivity and economic value of land disturbed by economic activity. The considered examples of exhausted mines in the 21st century in the USA, Canada, Germany, Romania, and Poland indicate a wide range of opportunities for their commercialization. The study of the potential for commercialization of exhausted mines in the post-Soviet countries testified to the underused reserves for the commercialization of their nature-resource potential and their high potential for further development. The authors proposed the identification of anthropogenic objects on the basic livelihood spheres of society. There were identified the main system (natural, biological, technical, economic, social, managerial) and structural (subjects, trends, threats, risks, problems, challenges) factors of diagnosing the state of an anthropogenic object. A set of measures has been developed for commercialization of an anthropogenic object in functional and production activities, product policy, financial and investment spheres, pricing and sales policies, promotion, management and determination of property rights. Recommendations were provided on optimizing the management decision-making process based on a set of positivistic development principles, methods, and management functions. The study allows international organizations, state and local authorities, territorial communities, owners and potential investors to see new opportunities and make mutually beneficial decisions on the rational use of the nature-resource potential of anthropogenic objects. Consumer distrust is only recently beginning to be perceived as an important e-commerce issue and, unlike online trust, the nature and role of distrust is much less established. This study examines the influence of two important consumer characteristics on consumer’s ethically-based distrust of online retailers. Also, the moderating role of consumer’s need for personal contact with sales staff is tested. Results from 409 online consumers confirm that both relativist-based ethical ideology and risk aversion are strongly and positively related to (...) consumers’ distrust. Interestingly, our findings show that positive effects of relativism and risk aversion on consumer’s distrust are moderated by consumers’ need for personal interaction, which is more pronounced for those consumers with a high need for personal interaction with retail salespeople. KasulisIntroductionPhilosophical circles worldwide have recognized the so-called Kyoto School for decades. Can we also speak of a modern Tokyo School and, if so, of its distinguishing nature? That question drives most articles in this journal’s special issue. Before beginning my inquiry, however, I have two preliminary questions. First, why is it important to ask whether there is, was, or even ever (...) will be something legitimately considered a Tokyo School? Second, how do the Japanese think in terms of schools, and what words might specifically designate a school of philosophy? I will try to answer these questions, not in an abstract or general way, but one that uses the Japanese cultural context for its point of departure.Japanese Regionalism and Japanese PhilosophyLet us start with the first issue: why ask whether there is a Tokyo School? One possibility, of course, is regional bragging rights between Kansai and Kantō as we find in, for example, sumō rivalries. In this version, for example, Kumazawa Banzan 熊沢蕃山 is the ōzeki and Ogyū Sorai 荻生徂徠 the sekiwake of the East, while the equivalents in the West are Arai Hakuseki 新井白石 and Itō Jinsai 伊藤仁斎.Such artifacts confirm a long history of East–West philosophical rivalries within Japan, but that hardly justifies our quest for a Tokyo School. Still, let us not too quickly dismiss the banzuke as simply an idiosyncratic curiosity; it has something more to teach us. If nothing else, it shows that at least in the Edo period, some intellectuals assumed a correlation between geographical location and philosophical perspective. That brings to light two common [End Page 6] present-day misconceptions, one about Japanese culture and one about philosophy.The first misconception is that Japanese culture is monolithic, or if it is not, that the Japanese like to think of their identity in that way. That mistaken view overlooks a potent force shaping Japanese identity: regionalism. The Japanese delight in celebrating the distinctive foods, crafts, scenery, dialects, festivals, and social customs of the different locales within the country. Even today, weeklong regional themes play out on morning TV shows as they broadcast on site from different locales throughout Japan. Undoubtedly a marketing ploy to encourage tourism, the shows also reinforce the Japanese sense of regional differences within their country. Grocery or department stores join in with weeklong “matsuri” campaigns dedicated to particular Japanese regions, highlighting sales of specialties in foods and crafts. If you go on a trip within Japan, your family and coworkers expect you to bring back omiyage as gifts—souvenirs or edibles distinctive to the place you visited. As a convenience for the harried traveler, train stations sell the omiyage associated with the specific locale.The recognition of regional differences within a single national identity traces back at least to the Nara period when the newly established central government began regularly compiling Fudoki 風土記 for each of the provinces. Those almanacs or gazetteers included details about the local demography, climate, agriculture, topography, dialects, local customs, festivals, folklore, and so forth. The East vs. West, Kantō vs. Kansai, or Tokyo (Edo) vs. Kyoto-Osaka contrast that interests us here became most prominent in the Edo period as Tokyo vied with Kyoto for prominence as the cultural center of Japan.4Centuries before anyone identified a “Kyoto School” of philosophy, the banzuke suggests that at least some intellectuals assumed that philosophizing in Kyoto-Osaka differed in some respects from philosophizing in Edo. Publishing is changing rapidly, though these changes are concealed from academics, who are presented the appearances of the old world of print. The economic incentives and consequently the strategies of publishers have, however, changed. Where quality was once the road to profit, content now is, and novel digital delivery systems are the key to sales. Academic libraries have become storefronts for digital sales. Editors have become content collectors. At the same time publishing has attempted to mimic the accessibility (...) of the web, shrinking the gap between “publication” and posting. This raises the question of what value is added by journal publication, and whether there is a justification for the huge cost. Some shorter and longer term perspectives suggest that the current value-added is linked to policies of evaluation, but that these may change. (shrink)

: The supply of organs for transplant remains inadequate to meet the needs of waiting patients, in spite of many programs and approaches to increase rates of donation. Over the years there have been numerous proposals to introduce schemes that would move toward the outright sale of organs. Three articles in this issue of the Journal propose methods for increasing organ supply—two by moving toward a market approach and the third by advocating a change in social culture. All three suffer (...) from shortcomings, including the endorsement and encouragement of the exploitation of those who may offer organs. Although the shortage of organs must be addressed, the social price of a market in organs is too high, and proposals to encourage a rethinking of social responsibility are unlikely to be effective. Though no immediate harm comes to individuals insured in this way, purchasing such policies raises moral questions. From a Kantian framework, questions arise about reciprocity and fairness, the deception of employees, the generation of mistrust, and the use of the employee’s life as a means to profit. CopenhaverEven before the Italians knew what to call their Renaissance, they knew the names of its heroes, one of whom was Lorenzo Valla. Accordingly, by the time Count Terenzio Mamiani della Rovere published one of the first modern histories of Italian philosophy in 1834, Valla's place in the story of that subject had long been established-for Italians, at least. "He began by ridiculing (...) blind trust in Aristotle's words," wrote Mamiani,and then went on to show how the highest categories and first predicables had been based on false assumptions, proving this by the correct meaning of terms, by the usage of speakers and by arguments from common sense. Valla overthrew the classifications of Porphyry in the same way. He shows how the basic rules of logic are simple and completely self-evident.1 [End Page 507]In tribute to Salvatore Camporeale of the Order of Preachers, I shall preach a sermon about this celebrated Italian philosopher. My text is an article on Valla that Campo published in 1986, and my contention is that Valla was a remarkably original thinker who has been much underrated in the Anglophone world, in part because he has not been read often enough or carefully enough in a contemporary philosophical framework.2The Philosopher's Index is the most important general bibliography for philosophers now writing in English. The on-line version that gives nearly four thousand references in five languages for Descartes, over nine thousand for Aristotle, and nearly ten thousand for Kant turns up only forty-two for Valla; twenty-five of these are in English, but only two are in major Anglophone journals of philosophy.3 I call that underrated and understudied.The first English-language entry for Valla in the Philosopher's Index dates from 1948, The Renaissance Philosophy of Man, a very influential book of readings (still in print) that presents Valla as a moral philosopher and Renaissance philosophy as not terribly important. The next entry, from 1964, refers to an equally influential book, Paul Kristeller's Eight Philosophers of the Italian Renaissance, one of whom is Valla, described by Kristeller not only as a moral philosopher but also, and more importantly, as a philosophical critic of logic and language.4 Around the same time, Hanna Gray, Jerrold Seigel, Charles Trinkaus, and others in this country had begun to study Valla's theory of language in more depth, and a few years later Camporeale's masterful book on Valla appeared in 1972.5Since Camporeale's book was then and is now the best account in any language of a brilliant philosopher, its absence from the Philosopher's Index indicates a kind of oblivion in Anglophone philosophy. In Europe and especially in Italy, by contrast, interest in Valla has been more or less continuous since his death in 1457. Mario Nizolio continued Valla's work in the sixteenth century, and both Valla and Nizolio were well known to Leibniz, who in turn [End Page 508] was the subject of an important book by Bertrand Russell in 1900.6 Russell's most popular work, however, was the History of Western Philosophy that he wrote much later, during the Second World War.7Many people have taken their bearings on the history of philosophy from Russell's exuberant History. Amazon.com still offers five editions by four publishers. And Amazon's rankings of sales of more recent accounts of the Renaissance period, the Cambridge History of Renaissance Philosophy and the Renaissance Philosophy volume of Oxford's History of Western Philosophy, lag far behind the figures for a single edition of Russell's broader treatment (8,970 Russell; 481,085 Cambridge; 507,316 Oxford).8Despite its great success, Russell's book does not do well by our topic. His treatment of the Renaissance is like Burckhardt directed by Victor Hugo and produced by Macaulay. Cardinals poison each other while free-thinking scholars entertain princes to procure patronage. Humanism meanwhile dozes under the rubble of antiquity, too dazed by the ruins to produce original philosophy. The only philosophical good to come from philology was its odium. Antidepressants, in particular newer agents, are among the most widely prescribed medications worldwide with annual sales of billions of dollars. The introduction of these agents in the market has passed through seemingly strict regulatory control. Over a thousand randomized trials have been conducted with antidepressants. Statistically significant benefits have been repeatedly demonstrated and the medical literature is flooded with several hundreds of.

In this study, we examined moral issues and gender differences in ethical judgment using Reidenbach and Robin’s [Journal of Business Ethics9 (1990) 639) multidimensional ethics scale (MES). A total of 340 undergraduate students were asked to provide ethical judgment by rating three moral issues in the MES labeled: ‚sales’, ‚auto’, and ‚retail’ using three ethics theories: moral equity, relativism, and contractualism. We found that female students’ ratings of ethical judgment were consistently higher than that of male students across two (...) out of three moral issues examined (i.e., sales and retails) and ethics theories; providing support for Eagly’s [1987, Sex Differences in Social Behavior: A Social-role Interpretation. (Lawrence Erlbaum Associates, Inc, Hillsdale, NJ, England)] social role theory. After controlling for moral issues, women’s higher ratings of ethical judgment over men’s became statistically non-significant. An empirical study using two ethics-related and three sales force outcome variables was conducted in Taiwan and compared to an existing U.S. sample. Across the two national cultures, individual perceptions of corporate ethics appears to be a more direct determinant of organizational commitment than individual moral values. Differences between the two national cultures were found in ethics perception as it relates to moral values, job satisfaction, and turnover intention. Explanations for the differences are discussed.

Life insurance settlements, or life settlements, are life insurance policies owned by investor-beneficiaries on the lives of unrelated individuals. With life settlements, investors make substantial payments to the insured individuals upon purchasing such policies, pay any remaining premius, and collect the death benefits upon the demise of the insured individuals. Transactions involving life settlements seem poised to become a major source of profits for investment banks, comparable in dollar amount to subprime mortgages. With life settlements, the insured individuals suffer no (...) immediate harm, and the sale of a policy an individual owns is permissible under current law. Nevertheless, moral questions can be posed about the social values expressed by these practices, the effect of these practices on the virtue of charity, and the overall loss of social utility that will result from life settlements. We consider life settlements from utilitarian and libertarian perspectives, and then consider the effects of life settlements on social values and on individual character. On balance, we favor legislative changes in insurance and tax laws to discourage life settlements, and argue that certain forms of life settlements should be banned outright. (shrink)

Financial products and options are frequently complex and difficult for consumers to understand, which, alongside positively oriented sales pitches and predatory practices, may lead to uninformed and hazardous financial decisions. While several legal reforms have been implemented to improve consumers’ understanding of financial products, these modifications have only achieved mixed results. An ongoing challenge is the passive nature of such modifications, giving rise to confirmation bias—noticing the information which confirms one’s belief about a product, while ignoring or not paying (...) enough attention to the potential risks. The aim of this study was to test an implementable form of public policy to help older adults successfully navigate these financial decisions. We tested whether a self-evaluation worksheet, involving an active manipulation of financial content, would significantly impact older adult participants’ responses in an experimental reverse mortgage scenario. Forty community-dwelling, healthy older adults were randomized to one of two conditions: Control Condition and Manipulation Condition. In addition to completing a comprehensive neuropsychological examination, participants were administered the Reverse Mortgage Task. Results indicated that a simple yet active manipulation—imparting accurate and understandable information regarding a complex financial product that must be further manipulated—led to the following among participants in the Manipulation Condition: declines in mood; superior understanding of the financial product; and reduced intention of purchasing the financial product. In order for older adults to be well informed about reverse mortgages, policies must be put in place to ensure that adequate and accurate information has been not only provided but also actively processed by the individual. The Internet has become one of the main tools for CSR information disclosure, allowing companies to publicise more information less expensively and faster than ever before. As a result, corporations are increasingly concerned with communicating ethically and responsibly to the diversity of stakeholders through the web. This paper addresses the main question as whether CSR information disclosure on corporate websites is influenced by country of origin and/or industry (...) sector. Analysing the websites of 127 corporations from emerging countries, such as Brazil, Chile, China, India, Indonesia, Mexico, Thailand and South Africa, it becomes evident that both country of origin and industry sector have a significant influence over CSR information disclosure on the web (CSRIDOW). How can law ethically regulate a future of fast-changing technologies? From recent inventions to science fiction, Future Law explores how law, ethics and regulation must respond to new technologies that challenge the boundaries of our ethics.

The paper focuses on the difference between event‐conditionals and premise‐conditionals. An event‐conditional contributes to event structure: it modifies the main clause event; a premise‐conditional structures the discourse: it makes manifest a proposition that is the privileged context for the processing of the associated clause. The two types of conditional clauses will be shown to differ both in terms of their ‘external syntax’ and in terms of their ‘internal syntax’. The peripheral structure of event conditionals will be shown to lack the (...) functional head Force, which encodes illocutionary force. Event conditionals are merged inside the IP of the matrix clause. Premise‐conditionals contain the head Force and they are merged outside the associated CP. (shrink)

Although Confucianism is a resilient cultural tradition in Asian societies, its role in their corporate governance systems is ambiguous. Confucian values have been pushed to the periphery because of a preoccupation in these countries to emulate corporate governance systems from the West. This article argues that Confucianism has much to offer in enhancing director conduct and corporate governance standards. As the attention of the global business community turns eastwards, it is opportune to revive interest in Confucianism and to explore ways (...) in which it can be integrated formally into companies' governance systems. The ability to sequence individual genomes is leading to the identification of an increasing number of genetic risk factors for serious diseases. Knowledge of these risk factors can often provide significant medical and psychological benefit, but also raises complex ethical and social issues. This paper focuses on one area of rapid progress: the identification of mutations causing long QT syndrome and other cardiac channel disorders, which can explain some previously unexplained deaths in infants (SIDS) and children and adults (SUDS) and (...) prevent others from occurring. This genetic knowledge, discovered posthumously in many cases, has implications for clinical care for surviving family members who might carry the same mutations. The information obtained from genetic testing, in the context of personal and family history, can guide individually tailored interventions that reduce risk and save lives. At the same time, obtaining and disclosing genetic information raises difficult issues about confidentiality and decision making within families. We draw on the experience of the Montefiore-Einstein Center for Cardiogenetics, which has played a leading role in the genetic diagnosis and clinical management of cardiac channel diseases, to explore some of the challenging ethical questions arising in affected families with adolescent children. We focus on the related issues of (1) family confidentiality, privacy and disclosure and (2) adolescent decision making about genetic risk, and argue for the value of interdisciplinary dialogue with affected families in resolving these issues.
